01Introduction

Welcome to Sagpan.app, a community-specific matrimonial platform designed exclusively for members of the Gujarati Sagpan Community of Gujarat, India and Gujarati Sagpan Community members residing abroad (NRI). These Terms & Conditions (“Agreement”) govern your access to and use of the Sagpan.app mobile application (the “Platform”), operated by Silversky Technology as a sole proprietorship registered in Gujarat, India.

This Agreement constitutes an electronic record under the Information Technology Act, 2000, and the rules made thereunder. It is generated electronically and does not require any physical or digital signature.

By registering on or using the Platform, you accept and agree to be bound by this Agreement and our Privacy Policy, as updated from time to time. If you do not agree, please do not access or use the Platform.

02Purpose of the Platform

Sagpan.app is a matrimonial facilitation platform whose sole purpose is to connect individuals of the Gujarati Sagpan Community who are seeking a life partner for marriage. The Platform provides profile discovery and communication tools only.

We do not act as a matchmaker, marriage counsellor, guarantor, or intermediary beyond profile discovery. Any decision to pursue, continue, or conclude a matrimonial alliance rests entirely with the users and their families.

The Platform is strictly not intended for casual dating, friendship, commercial solicitation, or any purpose other than a lawful matrimonial alliance.

03Eligibility

3.1 Age Requirement

To register on the Platform, you must have attained the minimum legal marriageable age as prescribed under Indian law — 21 years or above for males and 18 years or above for females.

3.2 Community Requirement

The Platform is exclusively for individuals who are members of, or directly related to, the Gujarati Sagpan Community of Gujarat. Registration is subject to community verification as described in Section 7.

3.3 Legal Capacity

By registering, you confirm that:

• You are legally eligible to marry under the personal laws applicable to you.
• You are not currently married or in a legally subsisting marriage, unless you are a divorcee or widow/widower as declared in your profile.
• You have the full legal right, authority, and capacity to enter into this Agreement.
• You are an individual natural person and not registering on behalf of a corporate or commercial entity.

04User Profile and Registration

4.1 Profile Registration

To access the Platform, you must register a profile using accurate and complete information. Each phone number can be linked to only one active profile at a time. You are responsible for all activity conducted under your profile.

You must notify us immediately at [email protected] if you suspect any unauthorised access to your profile. We are not liable for any loss resulting from failure to protect your credentials.

4.2 One Profile per Phone Number

A single phone number can hold only one active matrimonial profile on the Platform at any given time. If you wish to register a different profile (for example, for another family member or because the previous profile is no longer required), you must first delete the existing profile linked to that phone number. Once the existing profile is deleted, the phone number becomes available to register a new profile.

This rule applies equally to male and female profiles. Profile-specific features, restrictions, and subscription requirements (described in Section 5) apply to the single profile registered against the phone number.

4.3 Profile Accuracy

You are solely responsible for ensuring all information entered on your profile is accurate, truthful, and up to date. Providing false or misleading information may result in immediate removal of the profile.

05Membership Plans and Feature Access

Sagpan.app operates on a freemium model. Female profiles can be created and managed free of charge. Male profiles require an active subscription to access key features.

5.1 Female Profiles — Free of Charge

Creating and updating a female profile is completely free. There is no subscription requirement for female profiles. Female profile holders may use the Platform’s standard features without any paid plan.

5.2 Male Profiles — Subscription Required

The following features for male profiles are available only with an active subscription plan (monthly or yearly):

• Creating a new male profile
• Editing or updating an existing male profile
• Viewing the complete profile details of other members

Without an active subscription, a male profile holder can only view limited details of other profiles.

5.3 Subscription Plans

Subscription plans are available on a monthly or yearly basis. Current pricing and plan details are displayed within the Platform and may be updated from time to time.

5.4 Payments and Refunds

Payments made are final and non-refundable. For any questions, please contact our support team.

5.5 Plan Renewal

Subscription plans are valid for the period selected at purchase and do not automatically renew unless you explicitly opt in to auto-renewal before the end of the current period.

06Chat and Communication Features

6.1 How Chat Works

The Platform provides an in-app chat feature that allows members to communicate with potential matches. Chat is designed to facilitate matrimonial communication only.

6.2 Chat Access and Subscription

Access to chat is tied to the feature access rules of the respective male or female profile. Male profile holders must have an active subscription to initiate new chats, as viewing full profile details — the prerequisite for starting a chat — requires a subscription. Female profile holders can use chat as part of the free membership.

Sagpan.app is a communication facilitator only. We do not monitor, moderate, or take responsibility for the content of messages exchanged between members. Users are solely responsible for their conduct in chat.

07Verification and Community Check

For identity verification, the user may submit any one of the following government-issued documents: Aadhaar card, PAN card, Voter ID card, or Driving License. We verify only the name of the user as it appears on the submitted identity document. We do not verify income, employment details, educational qualifications, family background, marital history, or any other self-declared information on the profile.

The community membership check is conducted based on the identity document submitted by the user. We check whether the name and associated details suggest Gujarati Sagpan Community affiliation. This check is limited and not exhaustive.

If a user intentionally submits forged, tampered, or doctored identity documents, or provides false information to circumvent community eligibility requirements, the Platform bears no liability for any consequences arising from such fraudulent action. The entire responsibility in such cases rests with the user who submitted the false documentation.

We reserve the right to reject, suspend, or permanently remove any profile if we discover or have reasonable grounds to believe that fraudulent or misrepresented documents were submitted.

08User Conduct and Responsibilities

By using the Platform, you agree that:

• All information you provide on your profile is accurate, true, and not misleading.
• You will use the Platform solely for genuine matrimonial purposes.
• You will not use the Platform to harass, stalk, threaten, defraud, or exploit other members.
• You will not upload obscene, offensive, defamatory, or inappropriate content, including photos.
• You will not impersonate any other person or misrepresent your identity, community, age, or marital status.
• You will not use automated bots, scrapers, or other tools to extract data from the Platform.
• You will independently verify the information of any potential match before taking any further steps toward a matrimonial alliance.

We strongly advise users and their families to conduct their own due diligence, meet in safe settings, and verify credentials independently before entering into any matrimonial commitment.

09Disclaimer of Responsibility

Sagpan.app is a platform for discovery and communication only. We:

• Do not verify income, employment, educational qualifications, or family background claimed by users.
• Do not guarantee the accuracy or truthfulness of any information displayed on user profiles.
• Do not vouch for the character, behaviour, or intentions of any user.
• Are not responsible for any outcome, positive or negative, arising from a matrimonial alliance made through the Platform.
• Are not liable for any financial loss, emotional harm, legal dispute, or other damage arising between members.

By using the Platform, you acknowledge and accept these limitations. Any reliance on information provided by other users is entirely at your own risk.

10Intellectual Property

All content on the Platform, including design, text, graphics, logos, and software, is owned by or licensed to Sagpan.app. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without prior written permission.

By uploading photos or other content to your profile, you grant Sagpan.app a non-exclusive, royalty-free licence to display that content on the Platform solely for the purpose of providing the Services.

11Profile Termination

We reserve the right to terminate or suspend your profile at any time, with or without prior notice, for:

• Breach of any provision of this Agreement.
• Submission of false, fraudulent, or misleading information or documents.
• Use of the Platform for non-matrimonial, illegal, or harmful purposes.
• Complaints received from other users about abusive, harassing, or inappropriate behaviour.

Upon termination, your profile and data will be handled in accordance with our Privacy Policy. Subscription fees are not refundable upon termination due to breach of this Agreement.

12Limitation of Liability

To the fullest extent permitted by applicable law, Sagpan.app and its proprietor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, reputation, data, or goodwill, arising out of or in connection with your use of the Platform or reliance on any user-submitted information.

Our total cumulative liability to you for any claim arising under this Agreement shall not exceed the total subscription fees paid by you in the three months preceding the event giving rise to the claim.

13Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat, India.

14Amendments

We reserve the right to modify these Terms & Conditions at any time.
